Asset of Community Value Nomination (Localism Act 2011)
On Monday 15 November, we submitted nomination forms and supporting evidence to Reigate & Banstead Borough Council for various assets at New Pond Farm to be granted ACV status.
WGSPG aims and objectives are to preserve and protect the green spaces, recreational areas and allotments in Woodhatch.
If approved the site will be listed as an Asset of Community Value. In the event the landowner intends to sell the community group then has the opportunity to register its interest as a potential bidder. This triggers a six month moratorium period during which, subject to certain exceptions, the owner can only sell the asset if it is to a community interest group. After the six month moratorium period the owner can sell to whomever they choose.
WHY HAVE WE DONE THIS?
Recent developments suggest the future of the site is uncertain.
Our members and the wider community value the site and want the current uses to remain.
Access to the countryside, playing fields and allotments all provide a social benefit and further social well-being in a variety of ways which we consider should continue.
WHAT ARE COMMUNITY RIGHTS?
The Localism Act 2011 provided new rights and powers for local communities.
In 2017 the Government launched the 'You've got the power' to support and encourage communities to use the new rights provided by the Act to preserve what we like, and change what we don't like.
The 'Community Right to Bid' is one of several possible options.
The assets included in our nomination are:
- A00019 - New Pond Farm allotments
- A00780 - The Paddock allotments
- A00164 - Lonesome Lane recreation ground
- A08080 - New Pond Farm countryside commission land
- A08091 - New Pond Farm recreation ground
IMPACT ON PLANNING:
The above does not stop a landowner continuing to pursue development opportunities .
